Social Media Consent

Terms of use for user-generated content on social networks and its use by beCordial Hotels & Resorts.

The company CORDIAL CANARIAS HOTELS and RESORT, S.L. (and others*) hereinafter referred to as ("beCordial Hotels & Resorts"), requests permission from users of social media pages to display their favourite content on different websites and social channels.

ACCEPTANCE

In case that beCordial Hotels & Resorts is interested in using your Content, we may request your acceptance of these terms and conditions by commenting on the Content posted by you on the relevant social media page.

By responding with the hashtag #OKbeCordial you are consenting to beCordial Hotels & Resorts using your social content ("Social Content") and agreeing to these Terms of Use, freely, and without seeking compensation or financial gain.

USE OF THE CONTENT

You hereby grant to beCordial Hotels & Resorts and any of its affiliates, subsidiaries, parent and successor companies (the "Authorized Parties"), and any person authorized by them in accordance with these terms and conditions, a worldwide, perpetual, irrevocable, non-proprietary right, fully paid, non-exclusive, transferable and unencumbered right to edit, alter, copy, display, transmit, distribute, communicate to the public, publish and otherwise use the Content, including but not limited to websites and social media pages operated by the Authorised Parties. The Licensed Parties may use, display, reproduce, distribute, transmit, create derivative works, combine with other materials, alter and/or edit your Social Content in any manner in their sole discretion without any obligation to you.

You further grant to the Licensed Parties the right to use your username, real name, location and other identifying information, including but not limited to your voice, in connection with any use of your Social Content.

You hereby agree, represent and warrant that: (i) you are solely responsible for the User Social Content, (ii) you own all rights in and to the User Social Content and/or have obtained the relevant rights and permissions from other persons and/or entities that own, manage or may hold any rights with respect to such User Social Content, (iii) you are not a minor, (iv) the Authorised Parties' use of the User Social Content as described herein does not violate any rights, including but not limited to copyright, trademark, patent, trade secret or other privacy, moral, proprietary or other rights of any third party or any law or regulation and that (v) the User Social Content is not libelous, defamatory, obscene, pornographic, abusive, indecent, threatening, harassing, hateful, offensive or otherwise unlawful.

USE OF THIRD PARTY IMAGE

In the event that the Content contains any material that incorporates and/or depicts the names, likenesses, voices or other indicia identifying any individual, including, without limitation, a celebrity and/or other public or private figure, living or deceased (the "Image"), you:

- warrants and represents that such individual has granted you a worldwide, perpetual, unencumbered right to edit, alter, copy, display, transmit, distribute, communicate to the public, publish and otherwise use the Image, for any lawful purpose and to the fullest extent permitted by applicable law, including with respect to territorial, temporal and other restrictions, and that you are authorised to assign this right to a third party;

- warrants and represents that such individual has waived the right to inspect or approve any finished product on which the Image appears and has waived the right to receive any monetary or other compensation for any use of the Image by you or any third party;

- you grant to beCordial Hotels & Resorts and any of its affiliates, subsidiaries, parents and successors, and anyone authorised by them in accordance with these terms and conditions, a perpetual [3] and unencumbered right to edit, alter, copy, display, transmit, distribute, communicate to the public, publish and otherwise use such person's Image in posting on social media pages of beCordial Hotels & Resorts or its brands.

ADDITIONAL TERMS

These Terms of Use apply to the entire Website, the beCordial Hotels & Resorts Properties, the beCordial Hotels & Resorts services and your Social Content as a user unless otherwise indicated.. In addition, to the extent that Social User Content is displayed on the Web or on any of the beCordial Hotels & Resorts Properties or in connection with the beCordial Hotels & Resorts services, you shall also be subject to any additional Terms of Use, agreements, guidelines or rules provided by beCordial Hotels & Resorts and applicable to such beCordial Hotels & Resorts services and User Content, including, but not limited to, those set forth hereinafter on the becordial. com website, and you hereby agree to abide by such additional terms of use, agreements, guidelines, instructions or rules established or published by beCordial Hotels & Resorts (the "beCordial Hotels & Resorts Terms").

You certify that you are at least 18 years of age or the minimum legal age in your country.

RIGHTS OF THE USER

The user has the right to withdraw consent at any time by eliminating the #OKbeCordial hashtag and contacting RIU, through the platform on which the content was requested and used, for the purpose of communicating said withdrawal.
